1. Purpose

This Compliance Guide is intended to assist California Type 48 licensees (bars and nightclubs) in understanding how the Sip-Klip™ product may be utilized to satisfy the drink covering requirements set forth in California Assembly Bill 2375 (AB 2375).

2. Overview of AB 2375

Effective July 1, 2025, California Business and Professions Code Section 25657.6, enacted by AB 2375, requires specified on-premises alcoholic beverage licensees to:

“Provide, free of charge, upon request of a patron, a lid or cover that fits at least one type of drink container provided by the licensee to patrons.”

The legislative intent of AB 2375 is to reduce the incidence of drink spiking and contamination by ensuring patrons have access to a protective covering for their beverages while on licensed premises.

To utilize the Sip-Klip™ as part of an AB 2375 compliance strategy, licensees can provide a Sip-Klip™ and coaster to any patron requesting a lid, fulfilling their statutory obligation under AB 2375.

Licensees should also consider:

  1. Stock Adequate Supply: Maintain sufficient inventory of Sip-Klip™ units and compatible coasters
  2. Train Staff: Ensure employees understand how to provide and demonstrate proper use upon patron request
  3. Designate Compatible Drinkware: Identify at least one type of drink container in your establishment that functions with the Sip-Klip™ and coaster combination
  4. Document Availability: Consider posting signage indicating drink covers are available upon request

5. Regulatory Position

The California Department of Alcoholic Beverage Control (ABC) has confirmed the following regarding AB 2375 compliance:

The ABC does not evaluate, approve, or recommend any specific product. Each licensee has the discretion to determine which products meet the criteria of the law for their particular business.

Interpretation: The determination of whether a particular lid or cover satisfies the statutory requirement rests solely with the individual licensee. The Sip-Klip™ is offered as one potential solution that licensees may evaluate for their specific operational needs.
